Terms and Conditions for Using Mobily's

Direct Carrier Billing (DCB) Service

1. Definitions:

1.1.  Mobily: Etihad Etisalat Company.

1.2.  Customer: Mobily's postpaid or prepaid customers.

1.3.  Digital Service Providers: Mobily's partners who provide digital services to Mobily customers.

1.4.  Digital Services: Any digital content products or services that require a one-time payment or recurring subscription (weekly, monthly, etc.) and are offered by digital service providers to Mobily customers.

1.5.  Customers: Customers of Mobily eligible to use the Direct Carrier Billing (DCB) service.

1.6.  Direct Carrier Billing (DCB): An electronic payment system that allows Mobily customers to make electronic payments with Mobily collecting the payment for digital services on behalf of customers.

1.7.  Collection of Digital Services Value: Mobily's process of deducting the amounts due to digital service providers from the customer's balance or adding them to the monthly bill.

2. Limitation of Liability and Disclaimer:

2.1.   Mobily is responsible for collecting the value of digital services on behalf of digital service providers from customers.

2.2.   Digital service providers are responsible for providing digital services to Mobily customers.

2.3.   Mobily shall not be liable for any damages or losses incurred by customers through the use of the Direct Carrier Billing (DCB) service.

2.4.   Mobily shall not be liable for any issues or disputes related to digital services transacted through the DCB service.

2.5.   Mobily shall not be liable for setting or changing the prices of digital services.

2.6.   Digital service providers determine the prices and may change them based on their internal policies without prior notice.

2.7.   Mobily shall not be liable for any additional obligations or requirements related to digital service providers.

3. Conditions of Use:

3.1.   The Direct Carrier Billing (DCB) service is available to Mobily's postpaid and prepaid voice package customers.

3.2.   Mobily reserves the right to determine eligibility criteria for customers.

3.3.    Prepaid customers must have an active Mobily account to use the DCB service.

3.4.   Prepaid customers must have sufficient balance to use the DCB service.

3.5.   Mobily reserves the right to terminate or suspend the use of the DCB service at any time and for any reason, including but not limited to non-payment of amounts due for the DCB service or non-compliance with these terms and conditions, without prior notice.

3.6.   The customer acknowledges that the DCB service is independent and separate from their other services with Mobily, and canceling the subscription to the DCB service does not mean canceling their other subscriptions with Mobily.

3.7.   The DCB service is subject to the customer's credit limit.

4. Financial Terms and Collection Policy:

4.1.   Mobily will collect the due amounts from customers using the DCB service by deducting the amount from the customer's balance or adding it to the monthly bill.

4.2.   The customer agrees to authorize Mobily to collect the due amounts on behalf of digital service providers.

4.3.   The customer is responsible for paying any due amounts transacted through the Direct Carrier Billing (DCB) service.

4.4.   In case of payment failure, Mobily will send the customer details of the error or error code describing the reason for the payment failure.

4.5.   The refund of due amounts collected for digital services through the DCB service is subject to the policies of digital service providers.

5. Compliance with Laws and Regulations:

5.1.   These terms and conditions are subject to change or amendment without prior notice, and they are governed by the laws of the Kingdom of Saudi Arabia.

5.2.   Saudi courts have jurisdiction to settle any disputes arising from the interpretation or implementation of these terms and conditions.

5.3.   In case of any inconsistency between the Arabic and English texts, the Arabic text shall prevail.

5.4.   The customer acknowledges full legal capacity, awareness, and acceptance of all the terms and conditions of the Direct Carrier Billing (DCB) service as outlined above.
